IMPLEMENTASI ASAS SEDERHANA CEPAT DAN BIAYA RINGAN DALAM PERKARA PERCERAIAN DI PENGADILAN AGAMA KELAS IIB MAMUJU SULAWESI BARAT

Abstract

ABSTRAK: Penelitian ini bertujuan untuk mengetahui 1) Penerapan asas sederhana, cepat dan biaya ringan dalam perkara perceraian di Pengadilan Agama Kelas II B Mamuju Sulawesi Barat, dan 2) Faktor yang mempengaruhi penerapan asas sederhana, cepat dan biaya ringan dalam perkara perceraian di Pengadilan Agama Mamuju. Untuk mencapai tujuan tersebut maka peneliti menggunakan pendekatan deskriptif kualitatif, jenis penelitian kualitatif, sumber data primer yaitu informan penggugat sebanyak 2 orang, hakim 3 orang dan panitera 2 orang dan data sekuder yaitu dokumen, buku, jurnal dan perundang-undangan. Teknik pengumpulan data yang digunakan yaitu wawancara, observasi dan dokumentasi, Teknik analisis data yang digunakan adalah deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa: (1) Penerapan asas sederhana, cepat dan biaya ringan dalam perkara perceraian di Pengadilan Agama Kelas II B Mamuju Sulawesi Barat belum berjalan dengan efektif. Hal ini disebabkan oleh beberapa faktor yaitu faktor dari pihak Pengadilan dan faktor dari pihak penggugat/tergugat; (2) Faktor yang mempengaruhi penerapan asas sederhana cepat dan biaya ringan dalam perkara perceraian di Pengadilan Agama Mamuju adalah: a) Faktor dari pihak pengadilan yaitu kurangnya hakim dan pegawai, luasnya wilayah hukum, hakim berada diluar pada saat jadwal sidang karena adanya kegiatan dinas luar, sidang sering ditunda dan tidak  sesuai dengan jadwal waktu yang telah ditentukan, tidak adanya Posbakum, Panitera lambat membuat berita acara sehingga hakim lambat membuat putusan dan biaya perkara sering tidak sesuai dengan SOP. b) Faktor dari pihak penggugat/tergugat adalah tidak hadir saat persidangan, tidak dapat menghadirkan saksi, alamat tergugat yang tidak jelas, jauhnya wilayah tempat tinggal dan belum semua daerah terjangkau teknologi informasi.

ABSTRACT: This study aims to determine 1) the application of simple, fast and low-cost principles in divorce cases in the Religious Courts of Class II B Mamuju West Sulawesi, and 2) Factors affecting the application of simple, fast and low-cost principles in divorce cases in the Religious Courts Mamuju. To achieve this goal the researcher used a qualitative descriptive approach, a type of qualitative research, a primary data source, namely 2 plaintiff informants, 3 judges and 2 court clerks and secondary data namely documents, books, journals and legislation. Data collection techniques used are interviews, observation and documentation. The data analysis technique used is descriptive qualitative. The results of this study indicate that: (1) The application of simple, fast and low-cost principles in divorce cases in the Religious Courts Class II B Mamuju West Sulawesi has not been effective. This is due to several factors, namely factors from the Court and factors from the plaintiff / defendant; (2) Factors that influence the application of simple and fast principles and low costs in the divorce case in the Mamuju Religious Court are: a) Factors on the part of the court, namely the lack of judges and employees, the extent of the jurisdiction, the judge being outside at the hearing due to external service activities , hearings are often postponed and not in accordance with a predetermined time schedule, absence of Posbakum, Registrar is slow to make minutes, so judges are slow to make decisions and court fees are often not in accordance with SOP. b) Factors from the plaintiff / defendant are not present at the trial, unable to present witnesses, address of the defendant that is unclear, far from the area of residence and not all areas of information technology are affordable.
