ANALISIS DESKRIPTIF TINDAK PIDANA PENCURIAN HEWAN TERNAK DI POLRES BONE KABUPATEN BONE

Abstract

Penelitian in bertujuan untuk (1) mengetahui faktor terjadinya pencurian hewan ternak yang terjadi di wilayah hukum Polres Bone, (2) mengetahui upaya preemtif, preventif dan upaya represif yang dilakukan oleh aparat kepolisian untuk meminimalisir terjadinya tindak pidana pencurian hewan ternak yang terjadi di wilayah hukum Polres Bone. (3) mengetahui kendala-kendala yang dihadapi oleh pihak kepolisian dalam meminimalisir terjadinya tindak pidana pencurian hewan ternak di wilayah hukum Polres Bone. Penelitian ini merupakan penelitian deskriptif kualitatif, populasi dalam penelitan ini adalah penyidik unit resum Polres Bone Kabupaten Bone yang berjumlah 14 orang, penarikan sampel dalam penelitian ini menggunakan teknik purposive sampling yaitu sebanyak 2 orang penyidik unit resum Polres Bone Kabupaten Bone. Data penelitian ini dikumpulkan dengan pengumpulan teknik wawancara dan dokumentasi yang selanjutnya diolah dan dianalisis dengan menggunakan teknik analisis deskriptif kualitatif. Hasil penelitian menunjukkan bahwa (1) faktor yang mempengaruhi pelaku pencurian hewan ternak di wilayah hukum Polres Bone kabupaten Bone karena faktor ekonomi yang mendesak dan pengaruh lingkungan. (2) upaya yang dilakukan oleh aparat kepolisian terhadap tindak pidana pencurian hewan ternak di wilayah hukum Polres Bone kabupaten Bone yaitu: (a) upaya preemtif  dengan melakukan penyuluhan kepada masyarakat, melakukan patroli ke daerah yang rawan terjadi pencurian hewan ternak dan mengaktifkan ronda malam. (b) preventif atau pencegahan (1) melakukan patroli ke daerah yang waran terjadi pencurian hewan ternak dan mengaktifkan ronda malam. Upaya represif atau penindakan yang dilakukan oleh aparat kepolisian dalam meminimalisir terjadinya tindak pindana pencurian hewan ternak harus sesuai dengan peraturan hukum yang berlaku yakni dalam hal ini harus berdasar pada KUHP dan KUHAP. (3) kendala-kendala yang dihadapi yaitu kurangnya partisipasi masyarakat dan kondisi jalan yang tidak memungkinkan untuk mengjangkau TKP dengan cepat.

ABSTRACT: The study in aim to (1) determine the theft of cattle that occurred in the jurisdiction of Police Bone, (2) know the effort pre-emptive, preventive and repressive efforts made by the police to minimize the occurrence of the crime of theft of livestock that occurred in Bone Police jurisdiction. (3) to identify the constraints faced by the police in minimizing the occurrence of the crime of theft of livestock in the jurisdiction of Police Bone. This research is a qualitative descriptive study, the population in this research is investigating unit resum Police Bone Bone regency totaling 14 people, sampling in this study using purposive sampling technique that is as much as 2 units resum Police investigators Bone Bone regency. The research data was collected by the collection of interview techniques and documentation are further processed and analyzed using qualitative descriptive analysis technique. The results showed that (1) factors affecting the perpetrators of the theft of livestock in the jurisdiction of the district police station Bone Bone urgent because of economic factors and environmental influences. (2) the efforts made by the police to the crime of theft of livestock in the jurisdiction of Police Bone districts Bone namely: (a) attempts a preemptive to do outreach to the community, conduct a patrol to the area that is prone to theft of livestock and activate the night guard. (b) preventive (1) to patrol the area to warrant the case of theft of livestock and activate the night guard. Efforts repressive or prosecution conducted by the police in minimizing the occurrence of an offense of theft of livestock must be in accordance with the applicable legislation in this regard should be based on the Criminal Code and Criminal Procedure Code. (3) the constraints faced is the lack of public participation and road conditions do not allow for reach scene quickly.
