PENERAPAN SISTEM GUGATAN SEDERHANA (SMALL CLAIM COURT) DALAM PENYELESAIAN PERKARA WANPRESTASI DI PENGADILAN NEGERI MAKASSAR

Abstract

ABSTRAK: Penelitian ini bertujuan untuk mengetahui,(1) Penerapan sistem Gugatan Sederhana (Small Claim Court) dalam penyelesaian perkara wanprestasi di Pengadilan Negeri Makassar (2) Kendala penerapan sistem Gugatan Sederhana (Small Claim Court) dalam Penyelesaian Perkara Wanprestasi di Pengadilan Negeri Makassar. Jenis penelitian ini menggunakan metode deskriptif normatif dengan teknik pengumpulan data yaitu melalui observasi, wawancara, dokumentasi.Dari hasil penelitian menunjukkan bahwa (1) Penerapan sistem gugatan sederhana telah berusaha memenuhi ketentuan tata cara penyelesaian gugatan sederhana sesuai dengan PERMA Nomor 2 Tahun 2015 ditinjau dari aspek kriteria perkara dan prosedur tahapan beracara gugatan sederhana, namun belum cukup efektif dalam hal limitasi waktu penyelesaian dimana terdapat satu perkara yang melebihi batasan waktu penyelesaian yakni lebih dari 25 hari sejak sidang pertama. (2) Penerapan gugatan sederhana dalam penyelesaian perkara wanprestasi di Pengadilan Negeri Makassar terdapat kendala internal dan eksternal dalam pelaksanaannya (a) kendala internal tidak adanya peraturan yang jelas mengenai mekanisme eksekusi khususnya upaya paksa terhadap putusan-putusan gugatan sederhana, (b) kendala eksternal yaitu domisili tergugat yang pada blangko pendaftaran hanya berdasarkan keyakinan penggugat sehingga memunculkan kemungkinan tergugat telah pindah domisili dan berbeda yuridiksi hukum dengan penggugat dan masih kurangnya sosialisasi mengenai tata cara penyelesaian gugatan sederhana membuat pihak berperkara tidak paham mengenai alur proses penyelesaian perkara.

ABSTRACT: This study aims to determine, (1) Application of a Small Claim Court system in the settlement of a case of default in the Makassar District Court (2) Constraints in the application of a Small Claim Court in Settlement of Default Cases in the Makassar District Court. This type of research uses descriptive normative method with data collection techniques, namely through observation, interviews, documentation. From the results of the study indicate that (1) The application of a simple lawsuit system has attempted to fulfill the requirements for simple lawsuit settlement in accordance with PERMA Number 2 of 2015 in terms of Case criteria and procedure for the stages of a lawsuit are simple, but not effective enough in terms of limitation of the time of settlement where there is a case that exceeds the time limit for completion of more than 25 days from the first trial. (2) The application of a simple lawsuit in the settlement of a default case in the Makassar District Court has internal and external constraints in its implementation (a) internal constraints in the absence of clear regulations regarding the mechanism of execution, especially forced efforts against simple lawsuit, (b) external constraints, namely The defendant's domicile, whose registration is only based on the plaintiff's conviction, raises the possibility that the defendant has moved domicile and different legal jurisdictions with the plaintiff and the lack of socialization regarding the procedure for settling a simple lawsuit makes the litigant unaware of the process of settlement.
