PROSEDUR PELAKSANAAN BALIK NAMA SERTIFIKAT HAK MILIK ATAS TANAH DI KANTOR PERTANAHAN KABUPATEN BULUKUMBA

Abstract

Abstrak: Penelitian ini bertujuan untuk: (1) mengetahui prosedur pelaksanaan balik nama sertifikat hak milik atas tanah di Kantor Pertanahan Kabupaten Bulukumba, (2) mengetahui hambatan-hambatan yang timbul dalam prosedur pelaksanaan balik nama sertifikat hak milik atas tanah di Kantor Pertanahan Kabupaten Bulukumba. Penelitian ini menggunakan jenis penelitian deskriptif kualitatif. Pendekatan yang digunakan yaitu pendekatan kualitatif. Dengan menggunakan teknik pengumpulan data melalui observasi, wawancara dan dokumentasi. Sumber data terdiri dari data primer yaitu 4 orang Staf Pegawai Kantor Pertanahan Kabupaten Bulukumba, serta 3 orang pemohon, dan data sekunder berupa UUPA dan SOP BPN untuk mengetahui Prosedur Pelaksanaan Balik Nama Sertifikat Hak Milik Atas Tanah di Kantor Pertanahan Kabupaten Bulukumba. Hasil penelitian menunjukkan bahwa: (1) Prosedur Pelaksanaan Balik Nama Sertifikat Hak Milik Atas Tanah dapat dilakukan melalui beberapa tahapan, yaitu: pendaftaran sertifikat hak atas tanah, pemeriksaan berkas di Kantor Pertanahan, pembayaran biaya pendaftaran hak atas tanah, proses pengerjaan, pencatatan dan persuratan dengan jangka waktu 7 sampai 20 hari, penerbitan sertifikat. (2) Hambatan-hambatan dalam Prosedur Pelaksanaan Balik Nama Sertifikat Hak Milik Atas Tanah yaitu hambatan internal: sumber daya manusia (SDM) yang kurang, dan banyaknya permohonan yang masuk di Kantor Pertanahan Kabupaten Bulukumba. Adapun hambatan eksternalnya: banyaknya ahli waris yang tempat tinggalnya berjauhan, dan terdapat tunggakan Pajak-Pajak yang harus dibayarkan.

Abstract: This study aims to: (1) find out the procedure for implementing the name of the land title certificate in the Land Office of the Bulukumba Regency, (2) find out the obstacles that arise in the implementation procedure of the name of the land title in the Bulukumba District Land Office . This research uses qualitative descriptive research. The approach used is a qualitative approach. By using data collection techniques through observation, interviews and documentation. The data source consisted of primary data, namely 4 staff members of Bulukumba District Land Office Staff, and 3 applicants, and secondary data in the form of BAL and BPN SOP to find out the Procedure for Reverse Name of Land Rights Certificate at the Land Office of Bulukumba Regency. The results of the study show that: (1) The Procedure for Reversing the Name of Land Rights Certificate can be done through several stages, namely: registration of land title certificate, inspection of files in the Land Office, payment of registration fees for land rights, processing, recording and correspondence with a period of 7 to 20 days, certificate issuance. (2) Obstacles in the Implementation Procedure Name of Land Rights Certificate, namely internal barriers: insufficient human resources (HR), and the number of applications submitted at the Bulukumba Regency Land Office. As for external barriers: the number of heirs whose homes are far apart, and there are arrears in taxes that must be paid.
